General terms and conditions
Scope and Subject
These General Terms and Conditions (GTC) apply to participation in events, retreats, and workshops organized and conducted by Ice and Yoga Retreats and Events GmbH (hereinafter referred to as "Organiser"). Ice and Yoga Retreats and Events GmbH primarily provides paid services in the areas of yoga, ice bathing, sauna, breathwork, hiking, and event organisation. They apply to contracts concluded in any manner (personally, in writing, or electronically) between participants and Ice and Yoga Retreats and Events GmbH. A participant is any natural or legal person who utilizes the services. By using one or more services, the contracting party agrees to the application of these T&Gs.
Registration and Conclusion of Contract
Registration for a retreat, event, workshop, or other event takes place in writing or online via the registration form on our website.
By registering, the participant offers the Organiser the conclusion of a contract. The contract is concluded upon written confirmation of registration by the Organiser.
Payment Terms for Retreats
Upon receipt of the registration, the participant will receive an email with the bank details for payment of the retreat. The total amount for the trip is due upon registration. The place at the retreat is only definitively reserved once the amount has been paid. Registration is binding and obliges the participant to pay the full amount. Non-payment does not constitute cancellation. If payment is not made on time, travel services may be refused and cancellation fees may be charged. If the number of participants is limited, registrations will be considered in the order in which they are received. The date of receipt of the bank transfer applies.
Payment Terms for Events and Workshops
The full payment for all services must be made before the event date. Events and workshops can be paid via TWINT or bank transfer. Non-payment of the course fee does not constitute cancellation.
Cancellations for Retreats
For cancellations up to 90 days before the start of the retreat, the total amount minus 10% administrative costs will be refunded. Up to 40 days before departure, 50% of the total amount will be refunded. For cancellations at a later date, no refund of the total costs will be made. The participant has the option of naming a replacement participant. This must be done at the same time as the cancellation. A processing fee of CHF 150 will be charged, plus any external rebooking costs.
Cancellations for Events and Workshops
Registrations for workshops and events are binding. The costs are payable even if you do not attend. It is possible to find a replacement in advance: the replacement must be notified by email, stating their surname, first name and email address. A refund of part or all of the costs will only be made in the event of illness or accident upon presentation of a medical certificate before the start of the event.
Cancellations involve administrative work and must be communicated to the organiser by email. For workshops, events and similar formats, 20% of the course fees are non-refundable, even in the event of illness or accident. For cancellations up to 30 days before the start of the service, a fee of 25% of the course fees applies; up to 14 days before the start, 50% of the course fees apply. After that, the full amount is due.
Changes and Cancellation by the Organiser
The Organiser reserves the right to cancel or reschedule the event/retreat/workshop for an important reason (e.g., illness of the trainer or insufficient number of participants).
In case of cancellation by the Organiser, the participation fee will be fully refunded. No further claims by the participants exist.
Liability
Participation in the Organiser's events, retreats, and workshops is at the participant's own risk. The Organiser assumes no liability, particularly in cases where physical or mental conditions make participation inadvisable. The use of the course facilities and services is at the participant's own risk. No liability is assumed for valuables brought along.
The Organiser's liability is limited in any case to the extent and amount of the agreed service and covers only direct damage. The Organiser compensates for the failure of agreed services if it is not possible to provide an equivalent substitute service on-site. The Organiser is not liable if the non-fulfillment or improper fulfillment of the contract is due to:
Participant's failure before or during the trip.
Unforeseeable or unavoidable failures of a third party not involved in providing the contractually agreed service.
Force majeure or an event that the Organiser, the intermediary, or the service provider could not foresee or prevent despite due diligence.
Program Changes
The program and changes to individual services (accommodation, yoga teacher, means of transport) for unforeseen reasons or safety reasons are expressly reserved and are recognized by the participant upon registration. Any additional costs are borne by the participant. The Organiser strives to offer equivalent substitute services.
Entry Formalities
This is the responsibility of the participant. Compliance with entry requirements in foreign countries is the responsibility of the participant. Passports or identity cards must be valid at least until the date of return, and in some countries for at least 6 months after the date of return. The organiser accepts no liability for non-compliance with regulations and any associated costs, e.g. in the event of refusal of entry.
Trip Cancellation by the Organiser
A short-term trip cancellation due to force majeure, official measures, or strikes is reserved. Likewise, a trip can be canceled up to 60 days before departure due to not reaching the minimum number of participants. In this case, the paid trip price will be fully refunded. Further claims cannot be made.
Early Termination of the Trip by the Participant
If the participant has to terminate the trip prematurely for any reason, the price for the travel arrangement will not be refunded. The travel or course management will assist in organising the early return journey as much as possible. Any additional costs are borne by the participant.
Insurance conditions
The participant is responsible for adequate insurance coverage. It is the participant's responsibility to have sufficient health and accident insurance coverage in their domicile country, valid both domestically and internationally.
We advise participants to take out the following insurance policies: travel cancellation insurance, health and accident insurance.
Health Condition
By registering, the participant confirms that they are in a health condition to participate in the Organiser's events, retreats, and workshops. For acute physical or mental issues, it should be clarified with a doctor whether participation in the Organiser's events, retreats, and workshops is advisable. Yoga and ice bath can have a healing effect on physical and mental well-being. However, yoga and ice bath are not medical or psychotherapeutic treatments.
The course management reserves the right to refuse participants if the Organiser believes that the health or psychological conditions for participation in the Organiser's events, retreats, and workshops are not met. This refusal can also be issued at short notice or during ongoing courses. In this case, costs will be refunded proportionately.
The participant takes part in the yoga classes and workshops at their own responsibility and pays attention to their body's signals.
Data Protection and Copyright
The personal data collected during registration is used by the Organiser exclusively for the conduct of the Organiser's events, retreats, and workshops, treated confidentially, and not passed on to third parties. Exceptions include the transfer of data to employees and business partners for organisational reasons. The participant is also obligated to treat information about other course participants confidentially. The Organiser uses photos from events, retreats, and workshops on its own website or on its own social media channels (e.g., Facebook/Instagram) where participants may be recognizable. If a person does not wish this, they can request the Organiser to make them unrecognizable or remove them from the picture. Further and own claims cannot be asserted. The rights to names, logos, images, and content lie exclusively with the Organiser. All pages enjoy copyright protection. Imitations of any kind constitute a violation of copyright and will be prosecuted and require compensation for damages.
The participant agrees that photos and videos may be taken for advertising purposes during the Organiser's events, retreats, and workshops. This consent can be revoked at any time.
Final Provisions
The Organiser reserves the right to change these T&C at any time. Changes will be made accessible on the website and come into force upon publication..
If individual provisions of these T&C are or become ineffective, the validity of the remaining provisions remains unaffected.
These General Terms and Conditions have been written in German. An English translation is provided for information purposes only. In the event of any discrepancies or questions of interpretation, only the German version shall prevail and be legally binding. The German version of these Terms and Conditions shall be the only valid and enforceable agreement between the parties.
